Виокремлено нормативно-правові акти на національному рівні, які гарантують кожній особі право на судовий захист та обов’язковість виконання судових рішень. Характеризується процес виконання судових рішень у цивільних справах відповідно до національного законодавства. Підкреслено головне завдання цивільного судочинства, яке спрямовано на захист прав, свобод чи інтересів фізичних осіб, прав та інтересів юридичних осіб, інтересів держави. Підсумовується, що забезпечення виконання судового рішення є обов’язком держави, від виконання якого залежить авторитет судової влади, довіри до суду та віри у правосуддя. The paper is devoted to the main aspects of the execution of court decisions as the final stage of the civil process, special attention is focused on the problems of today. The meaning of the last stage of the civil process was analyzed and its place among other procedural actions was clarified. The reasons for the actual non-execution of court decisions are determined, which are related to the violation of the systematic organization of their implementation both procedurally and organizationally, and which are also related to the full-scale war in Ukraine. THE SPECIFICITY OF THE PROCEDURAL FORM OF SPECIAL PROCEEDINGS IN ADMINISTRATIVE PROCEEDINGS: ON THE EXAMPLE OF CASES AT THE REQUEST OF TAX AUTHORITIES(2022) ВОВК, Павло В’ячеславович; VOVK, PavloСправи за зверненням податкових органів, передбачені ст. 283 КАС України, становлять самостійний різновид судової процесуальної форми адміністративного судочинства. Відсутність у таких справах спору про право дозволяє цей тип провадження віднести до непозовного. Особливості процесуальної форми відбиваються у формі звернення, строках, обмеженні процесуальних повноважень суду на стадії відкриття провадження, доказовій діяльності, судових рішеннях. Загальне позовне і непозовне провадження за зверненням податкових органів співіснують як альтернативні форми судової легалізації застосування обмежувальних заходів. The unity of the procedural form in administrative proceedings is violated by the existence of cases not related to a legal dispute. There are not many such cases, but given the specifics of the configuration of public-law disputes, it can be assumed that they have the potential for further expansion, based on the general trend of strengthening judicial control over the activities of subjects of power. An example of such cases are the cases provided for in Art. 283, CAS of Ukraine. Українські підприємства приділяють увагу тільки матеріальній мотивації: використовують традиційні механізми матеріальної мотивації: видача заробітної плати, надбавок та одноразових премій, що зі свого боку знецінює прагнення працівників до конкурентоспроможності праці. Розроблено пропозиції мотивування працівників на транспортних підприємствах в сучасних умовах. The study is devoted to the actual problem of motivating personnel at transport enterprises, the urgency of which is beyond doubt, since finding ways to solve it is one of the most important issues of improving the economic mechanism. At the current stage, the problem of motivation is of great importance. The majority of Ukrainian enterprises pay significant attention only to material motivation, namely, they use traditional mechanisms of material motivation, i.e. the payment of wages, allowances and one-time bonuses, which in turn devalues the desire of employees for labor competitiveness. Personnel is the most complex and specific type of resources used by the enterprise in its activities. Therefore, the essence of motivation comes down to creating the conditions that denied workers the feeling that they could satisfy their needs with such behavior that ensures the achievement of goals organizations. The efficiency of the enterprise largely depends on the efficiency of the personnel. It is due to the employee's interest in the results of his work, when creating proper working conditions, it is possible to achieve an increase in labor productivity. Motivation is one of the main functions of management at all enterprises, because only under the conditions of effective motivation can the enterprise realize its potential for the highest quality economic growth. That is why the issue of improving the motivation of personnel at transport enterprises is one of the most urgent. The results. Охарактеризовано впроваджені зміни у механізмі регулювання зовнішньоекономічної діяльності в умовах воєнного стану. Виокремлено проблеми державного регулювання зовнішньоекономічної діяльності та окреслено майбутні перспективи розвитку. Встановлено, що під час воєнного стану зміни у регулюванні зовнішньоекономічної діяльності повинні враховувати часткову втрату логістичної інфраструктури, зростання рівня політичних ризиків, складність вибору партнерів для налагодження співпраці, щоб у подальшому сприяти ефективному введенню міжнародної торгівлі. COPYRIGHT IN PRIVATE INTERNATIONAL LAW: PROTECTION, OBJECTS, TYPESCOPYRIGHT IN PRIVATE INTERNATIONAL LAW: PROTECTION, OBJECTS, TYPES(2022) БАКАЙ, Юлія Юріївна; BAKAI, Yuliia; ГУДЗЕНКО, Юлія Олександрівна; HUDZENKO, YuliiaУ статі викладено дослідження проблеми захисту та охорони прав авторського права в міжнародному приватному праві. Зазначено, що питання захисту та охорони авторського права в сучасному світі є дуже актуальним і наразі не досконало вирішеним. Здійснено аналіз міжнародних договорів, учасницею яких є Україна. Зокрема, досліджено норми Бернської конвенції про охорону літературних і художніх творів 1886 р., Всесвітньої Женевської конвенції про авторське право 1952 р., Договору Всесвітньої організації інтелектуальної власності про авторське право (Договір BOIB) 1996 р., Угоди про торговельні аспекти прав інтелектуальної власності (Угода TRIPS) 1994 р. The paper presents a study of the problem of protection and protection of copyright rights in international private law. It is noted that the issue of protection and protection of copyright in the modern world is very relevant and currently not fully resolved. An analysis of international treaties, to which Ukraine is a party, has been carried out. In particular, the norms of the Berne Convention, the World Geneva Convention on Copyright of 1952, the Treaty of the World Intellectual Property Organization on Copyright (BOIB Treaty), the Agreement on Trade Aspects of Intellectual Property Rights (TRIPS Agreement) were studied. The main attention in this paper is devoted to copyright objects. It was determined that the objects of copyright include international treaties to which Ukraine is a party. It was also analyzed what differences exist in the basic conventions regarding the list of objects of copyright protection. The following criteria for the classification of copyright objects were studied: by scope of protection; by the level of accessibility for the public; by the degree of detail of their legal regulation; according to the term of legal protection. It is indicated that they are protected, unprotected, and limited copyright objects. The requirements that must be fulfilled in order for the work to receive the status of being released to the world have been studied. It has been analyzed which general and special terms of legal protection of copyright objects are established. Problems related to regulation, protection and proof of copyright infringement on the Internet have been identified. It is noted that authors have property and non property copyrights, as well as that these rights include international treaties. PECULIARITIES OF IMPORTING VEHICLES FROM THE USA(2022) ГАНАС, Любов Миколаївна; HANAS, Liubov; ТОДОЩУК, Андрій Васильович; TODOSHCHUK, Andrii; ХОМІК, Ольга Вікторівна; KHOMIK, OlhaУ статті проаналізовано особливості імпорту транспортних засобів із США, подана характеристика найбільших аукціонів, які представляють вживані пошкоджені та нові транспортні засоби, описано способи участі в аукціонах, наведено структуру імпорту транспортних засобів за 2021 р. визначено перспективи імпорту автомобілів. Також наведено деталізовану модель імпорту транспортних засобів із США, яка передбачає покроковий опис здійснення імпорту від моменту пошуку на аукціоні до моменту митного очищення в Україні з врахуванням специфіки навантаження, доставки в порт відправлення, вибору логістичного методу морського транспортування, способу страхування, внесення змін у ланцюг постачання шляхом побудови нових маршрутів через країни ЄС та митного очищення. In recent years, there is a tendency of growth in imports of vehicles. This situation is due to the formation of demand in the domestic market. Domestic enterprises are unable to meet this demand. The structure of imports is dominated by imports from EU countries (67.61%), but other markets such as the USA and countries of America (27.72%), North Korea (2.29%) and other countries are gaining new momentum. Imports of vehicles from the USA, Canada, Georgia and North Korea have now undergone certain logistical changes, because a large number of seaports are under occupation. This situation has caused a change in the route through the ports of the EU countries. Nevertheless, the prospects for expanding imports of vehicles from the USA are significant, because this market is represented by newer models, a wide range and nomenclature, cheaper segment, the availability of purchase due to the presence of a number of online auctions. The use of this model by a number of companies starting to import vehicles from the USA or planning to import, as well as having problems at certain stages of the import process, will allow to take into account all the nuances of this process and avoid mistakes. We can confidently state that communication and its mastery are one of the determining factors of the success and effectiveness of a construction business. The development of the communications policy occupies a significant place in the sales department of any enterprise and impacts the development of relations with potential clients and the entire organization as a whole. Досліджено особливості розмежування судової та позасудової форми захисту приватних прав. Акцентовано увагу на проблемах реалізації права на самозахист, переговори та медіацію як засобу захисту порушеного приватного права. Визначено особливості правового регулювання та відсутності такого позасудових способів захисту приватних прав для ефективного захисту цивільних прав шляхом мирного врегулювання спорів (конфліктів) у позасудовому порядку. Ефективне застосування на підприємстві системи управління знаннями дозволить значно знизити ризики ведення бізнесу, покращити швидкість та якість прийняття управлінських рішень, дозволить покращити інноваційну активність підприємства і підвищити його конкурентоспроможність. Today, in the era of the intellectualization of the economy, knowledge management plays an important role in building an effective strategy for the enterprise. The effective application of the knowledge management system at the enterprise reduces business risks, improves the speed and quality of decision-making processes, promotes innovative activity, and leads to an increase in the competitiveness of the enterprise. By applying an effective knowledge management system, an enterprise can achieve significant savings of resources, which is difficult to achieve using traditional management models and methods. У статті акцентовано увагу на необхідності ґрунтовного вивчення правового поля діяльності підприємства стосовно можливості використання зброї працівниками для виконання їх службових обов’язків і дотримання ліцензійних вимог та вимог дозвільної системи, що запроваджена органами Міністерства внутрішніх справ України. Розглянуто основні аспекти документального оформлення, обліку придбання та використання вогнепальної, пневматичної та холодної зброї і бойових припасів до неї підприємствами, які мають на це право згідно з чинним законодавством. In many cases, new competitors appear during the bringing the product to market, or by the time it appears, potential consumers are unprepared. In addition, there is a low level of innovation activity, due to the low level of innovation potential and insufficiency of resources to increase it. At the same time, first of all, innovative problems are put forward, while the importance of marketing in the innovative activity of the enterprise recedes into the background. The marketing component in innovative activity of the enterprise occupies a particularly important place, because determines the fate of many inventions and discoveries. Показано, що вихід на закордонний ринок складається з таких етапів: встановлення мети здійснення операцій, аналіз умов функціонування підприємств-партнерів, оцінювання зовнішнього середовища, вибір ринків збуту, пошук можливості виходу на них, складання угоди на реалізацію товару, визначення ціни товару та умови його постачання. The paper examines the peculiarities of applying various variations of cooperation, or "collaboration", in the field of HoReCa. In recent years, HoReCa's hospitality industry has been going through difficult times in conditions of uncertainty, such as the pandemic and post-pandemic periods and the escalation of the driving conflict in Ukraine. All these events negatively impact modern enterprises' development, especially enterprises in the field of HoReCa. Такий план складається з семи етапів: визначення передумов; аналіз чинників, що впливають на ЗЕД; аналіз державного регулювання ЗЕД; дослідження можливостей підприємства; формування стратегічних альтернатив; реалізація і контроль. Дотримання виконання усіх перелічених етапів надасть підприємству ефективно спланувати свою ЗЕД. Nowadays, the active development of market relations presupposes a responsible approach to the planning of foreign economic activity. After all, properly planned import and export activities are the key to improving the efficiency and increase the company's profits. Thus, when planning foreign economic activity, a step-by-step plan should be followed, which will eventually help to develop the company's strategy in this area. In the work on the basis of the conducted research the theoretical substantiation on development of strategy of planning of foreign economic activity is executed. The planning process is the foundation for the development of both the enterprise as a whole and in the field of foreign economic activity. The prospect of further research is to develop stages of implementation of methods and tools to improve foreign trade planning.
