Abstract
Монографія є комплексним і системним дослідженням кримінальної відповідальності за умисне знищення або пошкодження майна захисника чи представника особи. У роботі, з урахуванням положень чинного Кримінального кодексу України, досліджено історичний та міжнародний досвід умисного знищення або пошкодження майна захисника чи представника особи, охарактеризовано об’єктивні та суб’єктивні ознаки даного кримінального правопорушення, визначено особливості його кваліфікації, відмежування від суміжних діянь, а також розглянуто питання покарання за умисне знищення або пошкодження майна захисника чи представника особи. Видання призначене для працівників правоохоронних органів, науковців, студентів та курсантів закладів вищої освіти, всіх, хто цікавиться питаннями сучасного кримінального права. This monograph is a comprehensive and systematic study of criminal liability for the intentional destruction or damage of the property of a person’s defense attorney or representative. Taking into account the provisions of the current Criminal Code of Ukraine, the work examines historical and international experience regarding the intentional destruction or damage of the property of a person’s defense attorney or representative, describes the objective and subjective elements of this criminal offense, identifies the specific features of its classification and distinction from related acts, and examines the issue of punishment for the intentional destruction or damage to the property of a person’s defense attorney or representative. This publication is intended for law enforcement officials, scholars, students, and cadets at institutions of higher education, as well as anyone interested in issues of modern criminal law.
