    Місце та роль Національного банку України в механізмі Української держави. The place and role of the National Вank of Ukraine in the Ukrainian state mechanism

    Виходячи з аналізу як доктринальних так і нормативно-правових положень у статті визначено місце та роль Національного банку серед складових елементів механізму держави в Україні та окреслено функції держави в межах яких здійснюються відповідні повноваження. Зроблено акцент на тому, що Національний банк України серед структурних елементів механізму держави відноситься до апарату управління як складової апарату держави. В статті зроблено висновок про те, що Національний банк України може бути віднесений до контрольно-наглядових органів оскільки здійснює банківський нагляд за діяльністю банків та інших осіб з метою забезпечення стабільності банківської системи та захисту інтересів вкладників та кредиторів банку, а також контрольні заходи, що передбачені законодавством. Рада ж Національного банку України здійснює контроль за проведенням грошово-кредитної політики та нагляд за системою внутрішнього контролю Національного банку, що зумовлено нормативно закріпленими завданнями і корелюється з відповідними повноваженнями. Based on the analysis of both doctrinal and regulatory provisions, the article determines the place and role of the National Bank among the constituent elements of the state mechanism in Ukraine and outlines the functions of the state within which the relevant powers are exercised. Emphasis is placed on the fact that the National Bank of Ukraine, among the structural elements of the state mechanism, belongs to the administrative apparatus as a constituent of the state apparatus. The article concludes that the National Bank of Ukraine can be attributed to the control and supervisory authorities because it carries out banking supervision over the activities of banks and other entities in order to ensure the stability of the banking system and protect the interests of depositors and creditors of the bank, as well as supervisory measures provided for by law. The Council of the National Bank of Ukraine exercises control over the implementation of monetary policy and supervision over the internal control system of the National Bank, which is determined by statutory tasks and correlates with the relevant powers.
