Abstract
У статті здійснено комплексний аналіз особливостей реалізації та захисту прав людини в
умовах особливих правових режимів, зокрема воєнного та надзвичайного стану. Заналізовано вітчизняне й міжнародне законодавство у сфері правового захисту прав людини. The article provides a comprehensive analysis of the features of the implementation and protection of human rights in special legal regimes, in particular martial law and a state of emergency. Domestic and international legislation in the field of legal protection of human rights is analyzed. Emphasis is placed on the practical significance of the constitutional principle of the rule of law as a basis for the practical application of other constitutional guarantees, primarily guarantees of life, the inadmissibility of torture, the right to freedom and personal integrity, and the right to a fair trial.
