Abstract
Дисертацію присвячено комплексному теоретико-правовому, кримінальному процесуальному та криміналістичному дослідженню процесуального статусу, функції та діяльності захисника у кримінальних провадженнях про державну зраду, передбачену ст. 111 КК України. У роботі сформовано цілісну наукову концепцію реалізації права на захист у кримінальних провадженнях цієї категорії з урахуванням особливостей воєнного стану, застосування спеціального кримінального провадження за відсутності підозрюваного або обвинуваченого, використання результатів негласних слідчих (розшукових) дій, цифрових доказів, матеріалів із державною таємницею та підвищеного суспільного значення проваджень щодо злочинів проти основ національної безпеки України. The dissertation is devoted to a comprehensive theoretical, legal, criminal procedural, and forensic study of the procedural status, functions, and activities of defence counsel in criminal proceedings concerning high treason under Article 111 of the Criminal Code of Ukraine. The study develops an integrated scientific concept of the implementation of the right to defence in criminal proceedings of this category, taking into account the specific features of martial law, the application of special criminal proceedings conducted in the absence of a suspect or accused person, the use of the results of covert investigative (detective) actions, digital evidence, classified materials, and the increased public significance of proceedings concerning crimes against the foundations of Ukraine’s national security.
