Abstract
У статті проведено аналіз положень законів України «Про медіа» і «Про авторське право і суміжні права» щодо окремих видів майнових прав організацій мовлення на відповідність положенням міжнародних угод, які є частиною національного законодавства України. Вказано на протиріччя, які містять названі закони. На підставі аналізу чинного законодавства та нормативно-правових актів, що втратили силу, міжнародних угод та судової практики надано пропозиції щодо внесення змін та доповнень у законодавство України відносно майнових прав передач (програм) організацій мовлення. In the course of joining the European Union, Ukraine should harmonize its national legislation with the Pan-European legislation. Currently, it has been noted that, in line with its commitments, Ukraine has adopted two laws concerning media activities and intellectual property rights, in particular copyright and related rights. They are the Laws of Ukraine ‘Media’ and ‘Copyright and Related Rights’, the first replacing the earlier Law of Ukraine ‘Television and Radio Broadcasting’, and the second receiving a new wording. These laws embodied new approaches to media activities and copyright and related rights, new concepts and new objects of both media activities and copyright and related rights. However, when adopting these normative legal acts, the legislator did not fully take into account the specifics of subjects of related rights, in particular, broadcasting organizations, the scope and peculiarities of their property rights. As a result, some concepts and definitions regulating the activities of broadcasting organizations have been removed from the legislative field, some new concepts have not been defined, some concepts of one law contradict the concepts of another, and some definitions contradict the laws of physics in general, which makes it impossible to analyze and comment on them.
