Compensation for damage caused by injury, other damage to health or death, in accordance with the civil legislation of Ukraine and the European Union
Skrynyk Myroslava Vitaliivna
This monograph provides a comprehensive and systematic study of the legal regulation of compensation for harm caused to a person's life and health or by their death. Taking into account the current legislation of Ukraine and the practice of the European Union member states, the study explores the formation and development of relevant legal approaches, analyzes the grounds and conditions for the emergence of obligations to compensate for harm, characterizes their legal nature, and determines the specific aspects of assessing the amount of compensation and its components. Particular attention is paid to justifying an expanded approach to the scope of compensation, which covers rehabilitation costs, social adaptation, and other additional elements, as well as the liability of special subjects and consideration of non-standard working conditions. The application of a comparative legal approach to improving the national mechanism for protecting the rights of victims is examined separately. The publication is intended for scholars, practicing lawyers, judges, attorneys, public authoritiesʼ officials, undergraduate and postgraduate law students, as well as anyone interested in civil law and human rights protection.
