    Можливості мистецтвознавства в розслідуванні контрабанди культурних цінностей. The Potential of Art History in Investigating the Smuggling of Cultural Property

    У статті здійснено комплексний теоретико-прикладний аналіз можливостей мистецтвознавства в криміналістичному забезпеченні розслідування контрабанди культурних цінностей. Обґрунтовано, що предмет посягання в таких провадженнях має подвійний характер (матеріальний об’єкт і носій культурної/історичної цінності), що зумовлює підвищену складність доказування та необхідність системного застосування спеціальних знань у галузі мистецтва. This article provides a comprehensive theoretical and applied analysis of the potential of art history (art-historical expertise) within the forensic support framework for investigating the smuggling of cultural property. It is substantiated that, in such proceedings, the object of criminal encroachment has a “dual” nature–simultaneously a tangible item and a bearer of cultural and/or historical value, which increases the complexity of proof and necessitates the systematic use of specialized knowledge in the field of art.
