dc.description.abstractНа прикладі статті 299 Кримінального кодексу України висвітлюються різноманітні законодавчі помилки. Кінцевою метою відповідного критичного аналізу є спонукання законодавця до відповідального, максимально продуманого підходу стосовно конструювання кримінально-правових (й не лише) норм, такому підходу, що ґрунтується на глибокому знанні та розумінні КК України як системного утворення, врахуваннівзаємозв’язку усіх його положень між собою та нормами інших відповідних законів і базовими постулатами суміжних наук. As generally recognized, one of the most important laws for the country – the Criminal Code of Ukraine (hereinafter – the CC of Ukraine) – unfortunately contains a lot of erroneous regulations, sometimes even direct legislative errors, not only complicating the application of the law, but also reducing the level of respect and confidence in it. Thus, among the imperfect norms of the CC there are some, which strangely ‘concentrated’ various omissions – infringements of the elementary rules of logic, and the basic postulates of related sciences,and settled human perceptions. According to many scientists, Article 299 of the Criminal Code of Ukraine ‘Cruel Treatment of Animals’ belongs to such unfortunate (it is difÏcult trying to find another definition) norms. Therefore, this study is devoted to the critical analysis of this article.
