Abstract
У дисертації вирішено наукове завдання, що полягає в комплексному дослідженні обґрунтованості процесуальних рішень слідчого судді у кримінальному провадженні.
Встановлено, що потреба в обґрунтуванні кримінальних процесуальних рішень слідчих суддів у теорії не піддається сумніву, проте на практиці останні не здійснюють дослідження й оцінку доказів, посилаючись на відсутність відповідних повноважень. Зазначено, що в цьому полягає основна причина необґрунтованості кримінальних процесуальних рішень у порядку судового контролю.
This dissertation addresses the research objective of conducting a comprehensive study of the validity of procedural decisions made by investigating judges in criminal proceedings.
It has been established that the need to justify criminal procedural decisions by investigating judges is unquestionable in theory; however, in practice, the latter do not examine and evaluate evidence, citing a lack of relevant authority. It is noted that this constitutes the primary cause of the lack of justification in criminal procedural decisions subject to judicial review.
