Abstract
The article substantiates an understanding of the subject matter of proof as a system-forming category of criminal procedural proof that is not limited to the statutory list of circumstances provided for in Article 91 of the Criminal Procedure Code of Ukraine. This list constitutes the general statutory framework of the subject matter of proof, which may be supplemented by special provisions and requires individualisation in accordance with the criminal-law classification of the act, the factual circumstances of the case, the parties’ positions, and the type of procedural decision to be taken.
