| dc.description.abstract | У науковій статті досліджується становлення та особливості розвитку нормативно-правового регулювання конкурсного процесу Німеччини в XIX-XX ст.ст. Виявлено особливості Прусського конкурсного статуту 1855 року, зокрема, це: існування двох видів неспроможності – торгової та неторгової; пріоритетність комерційного конкурсу; можливість ініціювання торгового конкурсу щодо спадкового майна; встановлення кримінальної відповідальності як кредиторів, так і боржника у разі здійснення майнових дій на шкоду інтересам кредиторів; рівність між іноземними та внутрішніми кредиторами; втрата боржником права на розпорядження майном, яке потрапило до конкурсної маси. The scientific article examines the formation and peculiarities of the development of legal regulation of the competitive process in Germany in the 19th-20th centuries. The peculiarities of the Prussian bankruptcy statute of 1855 have been revealed, in particular: the existence of two types of insolvency – commercial and noncommercial; priority of the commercial competition; the possibility of initiating a commercial competition regarding inherited property; establishment of criminal liability of both creditors and the debtor in case of property actions that were caused to detriment of the interests of creditors; equality between foreign and domestic creditors; the debtor's loss of the right to dispose of property that has entered into the competitive estate. | |
