Abstract
У статті проведено порівняльний аналіз понять «протидія нелегальній міграції», «боротьба з нелегальною міграцію», «профілактика нелегальної міграції», «запобігання нелегальній міграції», «контроль над нелегальною міграцією». Визначено, що найбільш вдалим терміном, який відображає всі заходи впливу, які зобов’язана здійснити держава, щоб подолати це протиправне явище, є термін «протидія нелегальній міграції». З’ясовано, що процес здійснення протидії нелегальній (незаконній) міграції являє собою постійнодіючий правовий механізм, зміст якого розкривається через відповідні його елементи. До елементів правового механізму протидії нелегальній (незаконній) міграції автор традиційно пропонує зарахувати мету, об’єкти, завдання, напрями та заходи протидії. The article provides a comparative analysis with a focus on the following concepts: “countering illegal migration”, “fighting illegal migration”, “prevention of illegal migration”, and “prevention of illegal migration”, as well as “control over illegal migration”. It has been determined that the most effective term, which reflects all measures of influence that the state is obliged to implement in order to overcome this negative phenomenon, is the term “counteraction to illegal migration”. Under it, in particular, it is proposed to understand the system of legal and organizational measures carried out by authorized bodies of state power with the aim of regulating social relations in the field of migration by preventing, detecting, stopping violations of migration legislation, bringing guilty persons to justice, identifying and eliminating causes and conditions, contributing to illegal migration in Ukraine.
