| dc.description.abstract | Стаття присвячена дослідженню правової презумпції, її значенню в механізмі цивільно-правового регулювання в контексті оголошення фізичної особи померлою. Проаналізовано загальнотеоритичні та спеціалізовані наукові джерела. Вивчено загальнотеоретичні проблеми презумпції в праві, їхня роль, завдання й цінність для права. Окрему увагу приділено історії становлення презумпції. На основі чинного законодавства виділено й розглянуто сучасні проблеми цього питання. The article is devoted to the study of legal presumption, its significance in the mechanism of civil regulation, in the context of the declaration of death in civil law. The author analyses general theoretical and specialized scientific sources. General theoretical problems of presumptions in the law, their role, tasks and meaning for the law have been considered. Special attention has been given to the history of presumption. On the basis of the current legislation of Ukraine modern problems have been identified and discussed. | |
