| dc.description.abstract | Наукова стаття присвячена дослідженню актуального питання визначення предмета доказування в сучасному цивільному судочинстві України. У статті доведено, що аналіз чинного цивільного процесуального законодавства України, наукових висновків про зміст предмета доказування в цивільному судочинстві дозволяє вказати, що доволі логічно вивіреним є висновок про необхідність розрізнення понять «факт» і «обставина», з урахуванням того, що перше поняття наділяється ознаками найбільшої достовірності та здатності викликати юридичні наслідки судовим рішенням, котре набуло законної сили. The scientific article is focused on studying the topical issue of determining the subject matter of proving in modern civil proceedings of Ukraine. The author of the article has proved that the analysis of the current civil procedural legislation of Ukraine, scientific conclusions about the content of the subject matter of proving in civil proceedings allows indicating that the conclusion on the need to distinguish between the concepts of “fact” and “circumstance” is quite logical, taking into account the fact that the first concept is assigned with the features of the greatest credibility and ability to cause legal consequences to court decisions that have entered into legal force. | |
