Abstract
У статті автор аналізує теоретичні аспекти такого способу звернення стягнення на предмет іпотеки, як визнання права власності на нього за іпотекодержателем, а також практичне застосування законодавства стягувачами, боржниками і судом при подібному способі звернення стягнення. In this article the author analyzes the theoretical recognition of the right of ownership for the mortgagee by way of foreclosure on the mortgaged property, as well as the practical application of the legislation by the claimants, the debtors and the court at such method of foreclosure.
