Abstract
Наукова стаття висвітлює проблеми, які виникають на практиці у справах про позбавлення батьківських прав, пов'язаних із домашнім насильством. Серед них: доведення вини батьків, оцінка ризику повторного насильства, розподіл тягаря доказування між сторонами, а також вибір між позбавленням батьківських прав і менш суворими заходами захисту дитини. Звертається увага на те, що позбавлення батьківських прав є винятковим заходом. Суди застосовують його лише тоді, коли інші способи захисту дитини виявилися неефективними, а факти вини та неможливість виправлення поведінки батьків належно доведено. При цьому захист прав, безпеки й благополуччя дитини має пріоритет над правом батьків на виховання. The article examines the problems that arise in practice in cases concerning the deprivation of parental rights in connection with domestic violence. These include proving parental fault, assessing the risk of recurrent violence, allocating the burden of proof between the parties, and choosing between the deprivation of parental rights and less severe measures to protect the child. The article emphasises that the deprivation of parental rights is an exceptional measure. Courts apply it only when other means of protecting the child have proven ineffective and when parental fault and the impossibility of correcting the parents’ behaviour have been duly proven. At the same time, protecting the rights, safety and well-being of the child takes priority over the parents’ right to raise the child.
