Abstract
У статті з’ясовано особливості оборотоздатності таких об’єктів цивільних прав, як анатомічні матеріали людини. Обґрунтовано підхід щодо визнання анатомічних матеріалів людини обмежено оборотоздатними. Окрему увагу приділено питанню укладення цивільно-правових договорів щодо анатомічних матеріалів людини, визначено, які договори можуть укладатися для необхідності врегулювання правовідносин під час їхнього обігу. Зважаючи на особливий статус цих об’єктів, передусім немайнову природу, проаналізовано, які цивільно-правові конструкції не можуть бути застосовані. A characteristic feature of objects of civil rights is their circulability, and within the framework of this article, we consider that it is necessary to clarify the specifics of circulability
of such objects of civil rights as human anatomical materials. In connection with the special status of such objects, the article substantiates the approach to recognizing human anatomical materials as limitedly reversible. The article argues this by the existence of various transactions with human anatomical materials: certain agreements, biological testament, their ability to be objects of medical services, storage in biobanks, transfer for scientific purposes, creation of new objects from them, and international cooperation, in particular, in terms of exchange of anatomical materials.
