| dc.description.abstract | Стаття присвячена дослідженню предмета доказування у справах за позовом про поновлення на роботі працівника, звільненого у зв’язку із втратою довіри до нього за ініціативою роботодавця. На підставі аналізу правових позицій Верховного Суду автор визначає, що для правильного, повного, об’єктивного і всебічного розгляду категорії трудових спорів, що досліджується, судам необхідно встановлювати, чи працівник безпосередньо обслуговує грошові, товарні або культурні цінності, зокрема шляхом прийняття, зберігання, транспортування, розподілу тощо. The article is devoted to the study of evidence in cases on the claim for the reinstatement of the employee who has been dismissed due to the loss of confidence in such employee at the initiative of the employer. Based on the analysis of the Supreme Court’s legal positions, the author determines that in order to have correct, complete, objective and comprehensive consideration of the labor disputes category under study, the courts must establish if the employee directly serves the monetary, commodity or cultural values, in particular by their acceptance, storage, transportation, distribution, etc. | |
