Abstract
Дисертація є одним із перших в Україні комплексним дослідженням теоретичних і практичних засад розслідування зловживання впливом, в контексті чинного кримінального процесуального законодавства й актуальної судово–слідчої практики, зокрема, в умовах воєнного стану.
У роботі розроблено наукові основи розслідування зловживання впливом, які ґрунтуються на опрацюванні положень криміналістики, кримінального процесу, оперативно–розшукової діяльності, кримінального права, а також антикорупційного законодавства й правозастосовної практики правоохоронних інституцій та об’єднані в науковий продукт і практичний інструментарій, що включає створення описової моделі та розробку рекомендацій для досудового розслідування на її основі, предмет якої визначається криміналістичною характеристикою, зміст охоплює пошуково–пізнавальні процеси, що випливають із тактичних завдань, а напрям і послідовність процесуальних дій обумовлені слідчою ситуацією початкового етапу розслідування.
The dissertation is one of the first comprehensive studies in Ukraine on the theoretical and practical foundations of investigating influence peddling within the framework of the applicable criminal procedure legislation and relevant forensic practice, in particular, under martial law.
The work develops the scientific basis for investigating influence peddling, based on the provisions of criminalistics, criminal procedure, operational and investigative activities, criminal law, anti-corruption legislation, and law enforcement practice of law enforcement institutions. This basis is integrated into a scientific product and practical tools, including the creation of a descriptive model and the development of recommendations for pre-trial investigation based on it. Its subject is defined by the forensic characteristic, its content covers search and cognitive processes arising from tactical tasks, and the direction and sequence of procedural actions are determined by the investigative situation at the initial stage of the investigation.
