dc.description.abstractАналіз вітчизняних і зарубіжних правових, криміналістичних, управлінських та ІТ-джерел засвідчив, що проблема використання спеціальних знань під час розслідування незаконного використання гуманітарної допомоги належить до пріоритетних у сучасній доказовій практиці України. Дослідницька увага зосереджується на прозорості каналів постачання, антикорупційних запобіжниках, аудитно-ревізійних процедурах, цифрових слідах документообігу, а також на процесуальній інтеграції експертних висновків у доказування. В окресленому полі встановлено дефіцит уніфікованих процедур залучення знань, що ускладнює порівнянність практик і знижує керованість розслідувань; отже, виникає потреба у чіткому нормативному окресленні процедур, компетенцій і форматів документування результатів фахової участі. У дисертації аргументовано й досліджено концепт «спеціальних знань» як міждисциплінарного ресурсу, що поєднує управлінські, економічні, бухгалтерські, ІТ та правові компетенції; показано два сталі режими застосування – пряма інтеграція у тактику слідчих (розшукових) дій і отримання кваліфікованих висновків через консультації та судові експертизи, що разом забезпечує відтворюваність та прозорість процесуальних рішень. The analysis of domestic and foreign legal, forensic, management and IT sources showed that the problem of using special knowledge during the investigation of the illegal use of humanitarian aid is one of the priorities in modern evidentiary practice in Ukraine. Research attention is focused on the transparency of supply channels, anti-corruption safeguards, audit and revision procedures, digital traces of document flow, as well as on the procedural integration of expert opinions into evidence. In the outlined field, a shortage of unified procedures for involving knowledge has been identified, which complicates the comparability of practices and reduces the manageability of investigations; therefore, there is a need for a clear normative delineation of procedures, competencies and formats for documenting the results of professional participation. The dissertation argues and explores the concept of “special knowledge” as an interdisciplinary resource that combines managerial, economic, accounting, IT and legal competencies; two stable modes of application are shown – direct integration into the tactics of investigative (search) actions and obtaining qualified conclusions through consultations and forensic examinations, which together ensure the reproducibility and transparency of procedural decisions.
