Abstract
Статтю присвячено дослідженню історіографії вивчення судової правотворчості вітчизняними та зарубіжними науковцями. Вказано, що судова правотворчість є однією з важливих складових судової влади. У статті зазначається, що історіографія дослідження судової правотворчості надає змогу проаналізувати, з’ясувати та систематизувати стан знань про судову правотворчість, що в подальшому дозволить виокремити основні напрями наукового вивчення ролі судової правотворчості в системі явищ правової дійсності, а також дозволить виокремити площину, яка є найменш дослідженою і потребує відповідного опрацювання науковцями. The article is devoted to exploring the historiography of the study of judicial law-making by domestic and foreign scholars. It is noted that judicial law-making is one of the important components of the judiciary. The article indicates that the historiography of the study of judicial law-making makes it possible to analyze, clarify, and systematize the state of knowledge about judicial law-making, which in turn will allow identifying the main directions of scientific study of the role of judicial law-making in the system of legal phenomena and to identify the least explored area that requires appropriate processing by scholars.
