| dc.description.abstract | Статтю присвячено дослідженню правової природи договору факторингу в контексті його подібності до договору про відступлення права вимоги. Зокрема, було визначено та висвітлено основні проблеми, які виникають під час здійснення кваліфікації договірних відносин, що виникають за договором факторингу. Було також проаналізовано підстави визнання досліджуваних договорів недійсними в судовому порядку. The article under studies deals with the issue of the legal nature of the factoring agreement in terms of its similarity to the agreement on invoice discounting. In particular, the paper identifies and highlights the problems that occur in the course of implementing the qualification of contractual relations arising under the factoring agreement. It also analyzes the grounds for court’s recognizing the investigated agreements as invalid. | |
