Abstract
Дисертація є одним із перших у вітчизняній юридичній науці комплексним дослідженням теоретичних та практичних основ методики розслідування втручання в діяльність захисника чи представника особи, у контексті сучасного стану кримінального процесуального законодавства та правоохоронної практики. Методика містить криміналістичну характеристику кримінального проступку, передбаченого ст. 397 КК України, а також практичні рекомендації щодо організації початкового етапу розслідування, проведення окремих слідчих (розшукових) дій та використання спеціальних знань в умовах спрощеної процесуальної процедури проведення досудового розслідування у формі дізнання як засобу оптимізації та зменшення навантаження на слідчі підрозділи Національної поліції України. The dissertation is one of the first comprehensive studies of the theoretical and practical foundations of the methodology of investigating interference in the activities of a defense attorney or representative of a person in the context of the current state of criminal procedural legislation and law enforcement practice in domestic legal science. The methodology contains the forensic characteristics of the criminal offense provided for in Art. 397 of the Criminal Code of Ukraine, as well as practical recommendations regarding the organization of the initial stage of the investigation, the conduct of separate investigative (search) actions and the use of special knowledge in the conditions of a simplified procedural procedure for conducting a pre-trial investigation in the form of an inquiry as a means of optimizing and reducing the burden on the investigative units of the National Police of Ukraine.
