dc.description.abstract	Дисертацію присвячено дослідженню розслідування жорстокого поводження з військовополоненими та цивільним населенням. Доведено, що жорстоке поводження з військовополоненими та цивільним населенням належить до воєнних злочинів як тяжких порушень міжнародного гуманітарного права, а основою його кримінально-правової оцінки є низка міжнародних і національних джерел. Зокрема, категоріальні й нормативні орієнтири були вперше затверджені в Нюрнберзькому статуті, а згодом і в Римському. У них зафіксовано значну кількість заборонених діянь, що засвідчує їхню протиправність й одночасно заборону міжнародним і національним правом. Попри те, що Україна ратифікувала Римський статут Міжнародного Кримінального Суду, національний конституційний і процесуальний механізм надає можливість співпраці з цією установою та формує інструментарій міжнародної взаємодії в розслідуванні таких злочинів не достатньою мірою. The dissertation is devoted to the study of the investigation of the ill-treatment of prisoners of war and the civilian population. The author proves that the cruel treatment of prisoners of war and civilians belongs to war crimes as grave violations of international humanitarian law, and its criminal law assessment is based on a complex of international and national sources. The decisive ones are the categorical and normative guidelines laid down from the Nuremberg Statute to the Rome Statute of the International Criminal Court, which record a wide range of prohibited acts and emphasize their illegality (at the same time prohibited by international and national law). It is emphasized that, despite the lack of ratification of the Rome Statute by Ukraine, the national constitutional and procedural mechanism recognizes the possibility of cooperation with this institution and forms a toolkit for international cooperation in the investigation of such crimes.
