dc.description.abstractДисертацію присвячено комплексному дослідженню теоретичних, правових і прикладних аспектів використання електронних доказів у кримінальному провадженні України й інших держав. В умовах цифровізації суспільних відносин інформаційно-комунікаційні технології відіграють подвійну роль у сфері кримінальної юстиції: з одного боку, їх використовують для вчинення та приховування кримінальних правопорушень, з іншого – вони стають незамінним засобом їх виявлення та розслідування, оскільки більшість протиправних дій залишають цифрові сліди. Попри посилення доказового значення електронної інформації, її правовий статус, порядок збирання, фіксації, перевірки й оцінки залишаються недостатньо врегульованими на законодавчому рівні, що зумовлює актуальність дослідження. The dissertation provides a comprehensive study of the theoretical, legal and applied aspects of the use of electronic evidence in the criminal proceedings of Ukraine and foreign states. Amid the digitalisation of social relations, information and communication technologies have acquired a dual role in the sphere of criminal justice: on the one hand, they are used to commit and conceal criminal offences; on the other, they have become an indispensable means of detecting and investigating such offences, since the overwhelming part of unlawful activity leaves digital traces. Despite the growing evidentiary significance of electronic information, its legal status and the procedure for its collection, recording, verification and evaluation remain insufficiently regulated at the legislative level, which determines the relevance of the study.
