| dc.description.abstract | Актуальність статті полягає в тому, що важливе значення для правозастосовної діяльності має уявлення про те, чим саме є оціночне поняття, а також уявлення про особливості його застосування. Слід підкреслити, що в чинному законодавстві України відсутній термін «оціночні поняття». Натомість щодо його характеристики неодноразово висловлювалися вчені – представники як загальної теорії права, так і галузевих правових наук. Слід констатувати той факт, що у сфері цивільного права на нормативному рівні використовується понад сто оціночних понять, серед яких значне місце відводиться темпоральним (часовим) оціночним поняттям, які з позиції науки цивільного права є малодослідженими. The relevance of the article is that it is important for law enforcement activities to have an idea of what exactly is the concept of evaluation, as well as an idea of the peculiarities of its application. It should be emphasized that in the current legislation of Ukraine there is no term “valuation concepts”. Instead, its characteristics have been repeatedly expressed by scholars – representatives of both the general theory of law and branch legal sciences. It should be noted that in the field of civil law at the regulatory level uses more than a hundred valuation concepts, among which a significant place is given to temporal valuation concepts, which from the standpoint of civil law are poorly studied. | |
