Abstract
Стаття присвячена дослідженню особливостей реалізації спадкування в Україні в умовах новелізації цивільного законодавства. Здійснено аналіз норм цивільного права які врегульовують відносини в сфері спадкування, проаналізовано особливості здійснення спадкових прав та узагальнено законодавчі положення та наукову літературу з цього питання. Враховуючи прагнення України до повноправного членства в Європейському Союзі та становлення на шляху здійснення євроінтеграційних процесів сформульовано рекомендації щодо реалізації права на спадкування та подальшого вдосконалення спадкового права України. Процес реалізації спадкових правовідносин потребує всебічного дослідження для покращення функціонування системи спадкового права. The article is devoted to the study of the peculiarities of inheritance in Ukraine in the conditions of the amendment of the civil legislation. An analysis of the norms of civil law regulating relations in the sphere of inheritance was carried out, the peculiarities of the mechanism of the exercise of inheritance rights were analyzed, and the legislative provisions and scientific literature on this issue were summarized. Taking into account Ukraine’s aspiration to full membership in the European Union and becoming on the way to the implementation of European integration processes, recommendations were formulated regarding the exercise of the right to inheritance and further improvement of the inheritance law of Ukraine. The process of implementing inheritance legal relations requires a comprehensive study to improve the functioning of the inheritance law system.
