| dc.description.abstract | Стаття присвячена дослідженню проблем кондикційних відносин, що виникають у власників нерухомого майна в процесі викупу земельних ділянок державної або комунальної власності. Здійснено аналіз судових рішень Верховного Суду щодо можливості виникнення кондикційних зобов’язань у разі, коли власник об’єкта нерухомого майна оформлює право власності на земельну ділянку та на час подання позову ще не став власником земельної ділянки. Узагальнення судової практики Верховного Суду розгляду таких земельних спорів показує неоднозначність їх вирішення. The article is devoted to the study of the problems of condictio sine causa that arise among real estate owners in the process of buying out land plots of state or communal property. The analysis of the Supreme Court's judgments regarding the possibility of condictio sine causa when the owner of the real estate property issues the ownership right to the land plot and has not yet become the owner of the land plot at the time of filing the lawsuit was carried out. It is argued that from the moment of the decision by the local self-government body or the state authority to satisfy the application for the purchase of the land plot, accordingly, and to give consent to the expert evaluation of the land plot and/or the development of the land management project regarding the allocation of the land plot, relations arise between the parties regarding the further purchase of the land plot. | |
