Abstract
У статті проаналізовано актуальні питання кримінальної відповідальності за маніпулювання на енергетичному ринку. Розкрито об’єктивні та суб’єктивні ознаки маніпулювання на енергетичному ринку як кримінального правопорушення, описаного в ст. 222-2 КК, а також визначено шляхи подальшого вдосконалення кримінального законодавства у цій сфері. Встановлено, що маніпулювання на енергетичному ринку призводить до: 1) латентної монополізації енергетичного ринку, оскільки суб’єкти, які здійснюють досліджувані зловживання, нав’язують власні інтереси іншім суб’єктам господарювання та суспільству, ігноруючи при цьому їх потреби; 2) неправомірного збагачення одних учасників енергетичного ринку та збитків інших; 3) підвищення цін на енергетичні продукти для населення. Зроблено висновок про те, що маніпулювання на енергетичному ринку є спеціальним видом шахрайства, оскільки одні учасники цих ринків вводять в оману інших, у результаті чого правопорушники отримують незаконний прибуток, а потерпілі – матеріальні збитки. Аргументовано, що потерпілими від злочину, передбаченого ст. 222-2 КК, може бути як фізична, так і юридична особа, а суб’єктом – службова особа учасника енергетичного ринку. Із метою вдосконалення кримінально-правової заборони, передбаченої ст. 222-2 КК, запропоновано: 1) уточнити назву цієї статті, узгодивши її з диспозицією, а також враховуючи той факт, що ст. 163-18 КУпАП має тотожну назву (як варіант назву ст. 222-2 КК можна викласти в такій редакції «Маніпулювання на оптових енергетичних ринках електричної енергії та природного газу»); 2) ознаки маніпулювання на оптових енергетичних ринках визначити у відповідних законах; 3) виключити з тексту ст. 222-2 КК примітку 4, у якій визначається суб’єкт цього злочину. The article analyzes current issues of criminal liability for manipulation in the energy market. The objective and subjective elements of manipulation in the energy market as a criminal offense described in Art. 222-2 of the Criminal Code, as well as ways to further improve criminal legislation in this area, have been outlined.
It has been established that manipulation on the energy market leads to: 1) latent monopolization of the energy market, as the entities that carry out the investigated abuses impose their own interests on other economic entities and society, while ignoring their needs; 2) unjust enrichment of some energy market participants and losses of others; 3) increase in prices for energy products for the population.
A conclusion has been made that manipulation in the energy market is a special type of fraud, as some participants in these markets mislead others, because of which offenders receive illegal profits, and victims – material losses.
It has been argued that both a natural person and a legal entity can become victims of the crime provided for in Art. 222-2 of the Criminal Code and the subject can be an official of an energy market participant. In order to improve the criminal law prohibition provided for in Art. 222-2 of the Criminal Code, it has been proposed to: 1) clarify the title of this article, harmonizing it with the disposition, as well as taking into account the fact that Art. 163-18 of the Criminal Procedure Code has the same title (as an alternative, the title of Article 222-2 of the Criminal Code can be read as follows: “Manipulation in the wholesale energy markets of electric energy and natural gas”); 2) define elements of manipulation in the wholesale energy markets in relevant laws; 3) exclude note 4 from the text of Art. 222-2 of the Criminal Code, which defines the subject of this crime.
