Abstract
У статті досліджено сутність поняття «надзвичайна ситуація». Встановлено, що шляхом урахування потреб суспільства і держави є можливість сформувати якісний понятійний апарат, який відповідатиме принципу правової визначеності, оскільки за допомогою такої визначеності юридичні норми стають чіткими і точними та спрямовуються на забезпечення того, щоб ситуації та правовідносини залишались передбачуваними. Розглянуто широкий спектр дефініції понять «надзвичайна ситуація», що використовується в національному законодавстві, у вітчизняних і зарубіжних наукових джерелах. Використання різних наукових підходів (систематизації, порівняння та аналізу) дозволило в досліджуваному понятті виокремити характерні його ознаки. Зазначено роль і місце поняття «надзвичайна ситуація» у правотворчих і правозастосовних процесах у сфері цивільного захисту. Emergencies have already become an integral part of the modern world. They play a significant role in the lives of individuals, the state and society. The concept of «emergency situation» is the most important methodological prerequisite for the correct scientific and practical justification of the functions of civil defence subjects. Modern transformation processes contribute to the consistent modernisation of legislation and practice of applying the concept of «emergency» as a legal category. The article considers an emergency situation as a primary element of the driving force and development of state systems in the field of civil protection and the emergence of special social relations. In Ukraine, interaction regarding the protection of the population, territory, environment and property from emergencies and the response to them is regulated by the norms of legislation in the field of civil defence, which provide legal guarantees.
