dc.description.abstractАктуальність дослідження зумовлена посиленням ролі актів м’якого права у формуванні стандартів справедливого судочинства, доказування та судової аргументації. У сучасних умовахформально обов’язкові норми не завжди здатні оперативно реагувати на ускладнення суспільних відносин, цифровізацію доказової діяльності, розвиток міжнародних стандартів прав людини й потребу в уніфікуванні судової практики. The relevance of the study is determined by the growing role of soft law instruments in shaping standards of fair trial, proof, and judicial reasoning. In modern conditions, formally binding norms are not always able to respond promptly to the increasing complexity of social relations, the digitalization of evidentiary activity, the development of international human rights standards, and the need to unify judicial practice.
