Abstract
У дисертації визначено стан наукової розробленості проблем допиту. З’ясовано, що наукові дослідження у цій сфері мають комплексний характер, який стосується поєднання процесуальних, криміналістичних, психологічних, логічних, інформаційних (комунікативних) аспектів. Акцентовано увагу на недостатній розробленості проблем допиту під час розслідування воєнних злочинів. Встановлено, що наукові дискусії у цій сфері переважно носять фрагментарний характер, що окреслює необхідність комплексного дослідження організаційно-тактичних особливостей проведення допитів у кримінальних провадження про воєнні злочини, з урахуванням специфіки предмета їх доказування, особи допитуваного, характеру відомостей, що підлягають встановлення, особливостей комунікативної взаємодії, а також положень міжнародного законодавства, що регулюють матеріальні, процесуальні, організаційні та практичні аспекти доказування воєнних злочинів. The dissertation determines the state of scholarly research into the problems of interrogation. It has been established that research in this field is comprehensive in nature, encompassing a combination of procedural, forensic, psychological, logical, informational (communicative), and related aspects. Particular attention is paid to the insufficient development of issues pertaining to interrogation in the investigation of war crimes. It has been established that scholarly discussions in this field are predominantly fragmented, which demonstrates the need for a comprehensive study of the organizational and tactical features of conducting interrogations in criminal proceedings concerning war crimes, taking into account the specifics of the subject matter of proof, the status and characteristics of the person being interrogated, the nature of the information to be established, the specific features of communicative interaction, as well as the provisions of international law governing the substantive, procedural, organizational, and practical aspects of proving war crimes.
