    Стаття присвячена аналізу правової регламентації обставин, що обтяжують покарання. Встановлено, що у зв’язку з останніми змінами до Кримінального кодексу України (далі – КК) було введено нове поняття «кримінальний проступок». Кримінальний проступок – це діяння, за вчинення якого передбачене основне покарання у виді штрафу в розмірі не більше трьох тисяч неоподатковуваних мінімумів доходів громадян або інше покарання, не пов’язане з позбавленням волі. The article is devoted to the analysis of the legal regulation of circumstances that aggravate the punishment. A new concept of “criminal misconduct” was introduced into the Criminal Code of Ukraine. A criminal misconduct is an act for which the main punishment can be imposed in the form of a fine in the amount of not more than three thousand non-taxable minimum incomes of citizens or another, milder punishment than imprisonment. It has been established that when several criminal misconduct are committed, there may be signs of repetition or recidivism of criminal crimes.
