    ФОРМУЛА КВАЛІФІКАЦІЇ В КРИМІНАЛЬНОМУ ПРАВІ. Qualification formula in criminal law

    Статтю присвячено дослідженню формули (стандартів запису, формулювання) кваліфікації в кримінальному праві. З’ясовано, що формула кваліфікації в кримінальному праві становить позначення кримінально-правової норми, що підлягає застосуванню в разі здійснення кримінально-правової оцінки кримінально значимого діяння, тобто сукупність літерного та цифрового позначення статті (частини, пункту статті) Особливої частини КК та (або) статті (частини статті) Загальної частини КК, які передбачають вчинене кримінально значиме діяння і мають застосовуватися. The article is devoted to the study of the formula (standards of recording, formulation) of qualification in criminal law. It was found that the formula of qualification in criminal law is the designation of the criminal law to be applied in the criminal legal assessment of a criminally significant act, i.e. a set of letter and numerical designation of the article (part, paragraph) of the Special Part of the Criminal Code and (or) articles (parts of articles) of the General part of the Criminal Code, which provide for a criminally significant act and must be applied.
