    У статті висвітлено комплекс проблемних питань, які стосуються законодавчого регулювання конфіскації майна в процесі кримінального провадження. Наголошено, що конфіскація майна відіграє важливу роль як захід кримінально-правового впливу, який сприяє підвищенню ефективності процесу протидії злочинності та відновленню порушених прав потерпілих у результаті вчинення кримінальних правопорушень. The article is devoted to the analysis of such a criminal law institution as confiscation of property and consideration of the expediency of the existence of its separate forms as a measure of criminal law influence on crime in modern conditions.The main and important views of scientists who have already studied the problematic issues of legal regulation of property confiscation are outlined.

    У статті проаналізовано теоретичні аспекти формування ефективної системи управління відновленням економіки України після завершення або припинення воєнного стану; обґрунтовано науково-теоретичні основи удосконалення організаційно-господарських правовідносин; визначено основні передумови та стан процесів управління економікою у певному суспільно-історичному середовищі; узагальнено заходи щодо удосконалення управління організаційно-господарюючими системами як в умовах війни, так і в період повоєнної відбудови економіки. This article analyzes the theoretical aspects of the formation of an effective management system for the recovery of the economy of Ukraine after the end or termination of martial law; the scientific and theoretical foundations of the improvement of organizational and economic legal relations are substantiated; the fundamental prerequisites and the prevailing state of economic management processes within a specific socio-historical context are delineated. The article summarizes measures to improve the management of organizational and economic systems both in the war and in the period of post-war economic reconstruction.

FEATURES OF THE ACTIVITIES OF THE PEOPLE’S COMMISSARIAT OF INTERNAL AFFAIRS OF THE USSR IN THE TERRITORIES LIBERATED FROM THE NAZI OCCUPANTS IN LATE 1941 - THE FIRST HALF OF 1942

    У статті розглядаються історико-правові аспекти діяльності органів НКВС УРСР під час німецько-радянської війни на одному із переломних етапів розвитку держави та суспільства на звільнених від німецько-нацистських окупантів територіях наприкінці 1941 – першій половині 1942 років. На основі аналізу архівних відомчих нормативних та звітних матеріалів розкриваються завдання, що ставилися перед органами системи НКВС УРСР у зв’язку зі звільненням окремих територій. Підкреслюється актуальність вивчення та можливе використання позитивного досвіду минулого в сучасних умовах. The article deals with the historical and legal aspects of the activity of the bodies of the People’s Commissariat of Internal Affairs (hereinafter – PCIA) of the Ukrainian SSR during the Great Patriotic War, one of the turning points in the development of the state and society in the territories liberated from the Nazi occupiers in late 1941 – the first half of 1942. The author analyzed the normative and reporting materials of the archival departments. It shows the complexity of the tasks, which the bodies of the PCIA system of the Ukrainian SSR had to face after the liberation of certain territories from the Nazi occupants. In the course of analyzing published and found in the archives departmental normative and reporting materials, new aspects of the tasks that were set before the bodies of the PCIA system of the Ukrainian SSR in connection with the liberation of certain territories from the occupants, and some results of their implementation in late 1941 – the first half of 1942 are revealed.

    У статті розглядаються питання культури зовнішнього вигляду правоохоронця в історико-правовому аспекті, а також сьогоденні підходи до цієї проблеми. Автор уперше вводить до наукового обігу архівний документ – наказ міністра внутрішніх справ УРСР від 15 квітня 1961 р. «Про заходи поліпшення зовнішнього вигляду особового складу», здійснює його детальний аналіз та оцінку з погляду сучасної української поліцеїстики. The article deals with the issues of the appearance culture of law enforcement ofÏcers in the historical and legal aspect, as well as the current approaches to this problem. The author presents an archival document for the first time in a scientific context. The document is the order of the Minister of Internal Affairs of the Ukrainian SSR from April 15, 1961, titled “On measures to improve the appearance of personnel”. It is subjected to a comprehensive analysis and evaluation from the standpoint of modern Ukrainian policing.The results of numerous studies clearly indicate that the image of a police ofÏcer is predominantly associated with the male gender in the public imagination. However, recent developments have brought about notable shifts. There has been a notable increase in the number of women joining the police force. This process is understandable and logical process, yet the intricate challenges associated with it should be given due consideration by the scientific community.

    «РЕГУЛЬОВАНИЙ» ГОЛОДОМОР: РАДЯНСЬКА ДЕРЖАВА І ГОЛОД В УКРАЇНІ 1946–1947 РР. «REGULATED» HOLODOMOR: THE SOVIET STATE AND FAMINE IN UKRAINE 1946-1947

    Розкриваються основні аспекти актуальності теми голоду в Україні у 1946– 1947 рр., зважаючи на глобальну продовольчу проблему у світі, а також як однієї із найтрагічніших сторінок в історії України. Наголошується, що сучасні російські історики відійшли від наукових принципів при вивченні цієї проблеми, перейшовши, в умовах широкомасштабної російської агресії проти України, на пропагандистські штампи неоімперської ідеології. Документи свідчать, що в роки голоду повною мірою були продемонстровані такі негативні риси радянського державного апарату, в тому числі і МВС–МДБ, як безініціативність, неповороткість, бездушність, неприхований цинізм стосовно маси населення, невміння прогнозувати розвиток ситуації і спрацьовувати «на випередження». This article reveals the main aspects of the actuality regarding the topic of famine in Ukraine in 1946-1947, considering the global food problems in the world, as well as one of the most tragic pages in the history of Ukraine. When searching for solutions to one of the most pressing issues of human society, namely preventing and overcoming famine, scientists should examine the past to identify and apply positive experiences in modern circumstances while also considering negative experiences and lessons learned from history. For our nation and domestic science, these questions are of special importance. Only in the first half of the twentieth century, Ukraine experienced three mass artificial holodomors, which had catastrophic consequences for agriculture, demographic development and mental health of Ukrainians. At the same time, the mass famine of 1946-1947 was largely overshadowed by two other tragedies - the Holodomor of 1921-23 and, above all, the Great Holodomor of 1932-33 - and was inferior to both in terms of territorial extent, human losses, and other consequences.

    У статті розглянуті проблемні питання щодо гарантування громадянам України права на мирні зібрання, завдань Національної поліції у цій сфері правоохоронної діяльності. Наголошено на необхідності законодавчого врегулювання правових засад реалізації гарантованого Конституцією України права на свободу мирних зібрань, а також повноважень органів правопорядку під час проведення мирних зібрань. Визначено напрями удосконалення механізмів забезпечення Національною поліцією правових гарантій на мирні зібрання. The article was prepared with the aim of identifying ways and directions for improving the legal regulation and mechanisms of the National Police in providing legal guarantees for peaceful assembly in Ukraine. For achieving this goal, international standards in the field of fundamental freedoms and human rights, domestic and foreign experience of law enforcement agencies in ensuring security and order at such public gatherings, etc. were studied.
