    Стаття присвячена оцінці правової регламентації договору про передання виключних майнових прав інтелектуальної власності як підстави для виникнення правонаступництва щодо майнових авторських прав. У процесі дослідження автори аналізують притаманні для договору про передання виключних майнових прав інтелектуальної власності істотні умови, внаслідок чого доходять висновку, що єдиною істотною умовою, яку доцільно закріпити для цього договору на законодавчому рівні, є умова про предмет, адже закріплення таких умов, як «ціна» та «територія», матимуть наслідком звуження прав контрагентів та принципу свободи договору загалом. The article is devoted to the legal assessment of the regulation of intellectual property transfer agreement as the grounds for the succession of property copyrights. In the course of the study, the essential conditions typical of intellectual property transfer agreement have been analyzed, resulting in the conclusion that the only essential term that should be expedient to legislate is the term about the subject matter as the provision of such terms as ‘price’ and ‘territory’ will have the effect of narrowing the rights of counterparties and the principle of freedom of such an agreement in general.
