    ОСОБЛИВОСТІ НОРМАТИВНОЇ МОДЕЛІ ІНСТИТУТУ ЗАСТАВИ В КРИМІНАЛЬНОМУ ПРОВАДЖЕННІ. Features of the regulatory model of the institution of bail in criminal proceedings

    Досліджено нормативну модель інституту застави в кримінальному провадженні, вплив цього заходу на забезпечення прав підозрюваного, обвинуваченого, заставодавця. Доведено, що застосування застави має публічний характер, оскільки цей захід примусу застосовується суб’єктом від імені держави, якого наділено владними повноваженнями. Зауважується, що досліджуваний захід пов’язаний з певними правообмеженнями саме у сфері матеріальних інтересів особи, застосування щодо неї встановлених кримінальними процесуальними нормами санкцій, якими передбачено виконання низки процесуальних обов’язків, пов’язаних із забезпеченням належної поведінки та можливості вжиття більш суворих запобіжних заходів у разі невиконання раніше накладених санкцій. The normative model of the institution of bail in criminal proceedings, and the impact of this measure on ensuring the rights of the suspect, accused, and pledger is investigated. It is proved that the use of bail is public in nature since this measure of coercion is applied by the subject on behalf of the state that is vested with powers. It is noted that the studied measure is associated with certain legal restrictions in the sphere of material interests of a person, the application of sanctions against him established by criminal procedural norms, which provide for the fulfillment of a number of procedural duties related to ensuring proper behavior and the possibility of taking stricter preventive measures in case of non-compliance with previously imposed sanctions.
