    Розглядається малодосліджена проблема кримінального права – законодавче відображення місця вчинення злочину як невід’ємного компонента в межах низки обставин, які пом’якшують чи обтяжують покарання. Наголошується на тому, що увага науковців і практиків до цих кримінально-правових аспектів здатна відігравати помітну роль під час ухвалення судових рішень – їх належної обґрунтованості в частині диференціації відповідальності та дотримання принципу домірності (справедливості) покарання, що призначається винуватим особам. Розкрито зміст зазначених обставин в аспекті предмета дослідження. The article provides an in-depth analysis of the issues surrounding the place of commission of a crime, which are often overlooked in the context of criminal law doctrine. The lack of scientific study in this area is due to a number of factors. Primarily, there has been limited attention from specialists on the issue of crime scenes in general. Secondly, there has been a low incidence of the use of crime scenes as a factor affecting the individualisation of punishment in law enforcement practice. Another area that requires further investigation is the impact of the location where a crime is committed on the differentiation of criminal liability.
