Здійснено аналіз наукових позицій щодо договірної правотворчості, які склалися в юридичній літературі. Виокремлено суб’єктів, уповноважених на таку діяльність з метою реалізації функцій сучасної держави Україна. З’ясовано позиції щодо розуміння нормативного договору, зокрема і його видів. Виявлено правову природу нормативно-договірної правотворчої форми реалізації функцій сучасної держави Україна. Сформульовано визначення її поняття. The article is devoted to the study of normative-contractual law-making form of realization of functions of the modern state of Ukraine. An analysis of scientific positions on contract lawmaking, which have developed in the legal literature. The subjects authorized for such activity for the purpose of realization of functions of the modern state of Ukraine are allocated. Positions on the understanding of the normative agreement, including its types, have been clarified. The legal nature of the normative-contractual law-making form of realization of functions of the modern state of Ukraine is revealed. Аналіз наукового розуміння цього явища сприяв формуванню уявлення про його можливості. Вказано на важливість наскрізного здійснення правового моніторингу щодо правових форм реалізації функцій сучасної держави Україна. Спрогнозовано перспективні зміни правових форм реалізації функцій сучасної держави та їх результатів за участі правового моніторингу./ The article is devoted to legal monitoring and its role in the process of improving the legal forms of implementation of the functions of the modern state of Ukraine. Analysis of the scientific understanding of this phenomenon contributed to the formation of ideas about its possibilities. The importance of end-to-end legal monitoring of the legal forms of realization of the functions of the modern state of Ukraine is pointed out. Perspective changes of legal forms of realization of functions of the modern state and their results with the participation of legal monitoring are forecasted.
