    У статті автором підіймається питання правового режиму об’єкта речових прав на чужу річ та його особливостей. Вказується, що речові права на чужу річ складають окрему групу прав, що в межах речово-правового режиму забезпечують економічну участь однієї особи у праві власності іншої. Поява таких прав була зумовлена необхідністю забезпечити можливість міцного, тобто не залежного від простої особистої згоди, участі однієї особи в праві власності іншої. Саме це відрізняє вказані права від прав на чужу річ, що можуть надаватися в межах зобов’язально-правового режиму. The author focuses on the legal regime of object of right in re aliena and its specific features. The author denotes that right in re aliena constitute a separate category of rights which, within the legal regime of property rights, ensure the economic involvement of a person in the property right of another. The emergence of such rights has been driven by the need to ensure that one person’s involvement in the property right of another is solid and thus not subject to mere personal consent. This is exactly what sets these rights apart from the rights in the property of another, which may be granted under the legal regime of obligations law.
