    Актуальність теми даного дослідження обумовлена потребами науки кримінального процесуального права та правозастосовної діяльності суду першої інстанції щодо вдосконалення положень ст. 337 Кримінального процесуального кодексу України (далі – КПК України), які закріплюють межі судового розгляду та право суду змінити обвинувачення під час ухвалення підсумкового рішення. На підставі аналізу чинного національного законодавства, судової практики, наукових публікацій визначені окремі проблемні ситуації належного врегулювання в ч. 3 ст. 337 КПК України права суду змінити обвинувачення та сформульовані пропозиції щодо їх подолання. The relevance of the topic of this study is determined by the needs of the science of criminal procedural law and the law enforcement activity of the court of first instance regarding the improvement of the provisions of Art. 337 of the Criminal Procedure Code of Ukraine (next – CPC of Ukraine), which fix the boundaries of the trial and the right of the court to change the accusation during the adoption of the final decision. On the basis of the analysis of current national legislation, judicial practice, and scientific publications, certain problematic situations of proper regulation have been determined in Part 3 of Art. 337 of the CPC of Ukraine the right of the court to change the indictment and formulated proposals to overcome them.
