    Сьогодні серед найбільш масштабних явищ, які становлять пряму загрозу для життя та здоров’я людини як найвищої соціальної цінності, поряд з іншими чинниками й кримінально протиправні ДТП. Реалії свідчать про те, що кількість загиблих і постраждалих унаслідок ДТП фактично зіставна з кількістю жертв від воєнних дій. Недосконалість законодавства в частині надання потерпілому професійної правничої допомоги перешкоджає жертвам ДТП та їхнім родичам обстоювати свої права та законні інтереси, добиватися справедливого покарання винних та одержувати належні компенсації. Водночас нерозробленість науково обґрунтованих методик щодо дій представника потерпілого від ДТП в кримінальному провадженні зумовлюють недостатню ефективність такої допомоги. Тому потрібні заходи, які приведуть як до покращання процесуального статусу потерпілого від ДТП та його представника, якості кримінального процесуального законодавства, так і до підвищення ефективності кримінальної процесуальної діяльності. Today, among the most extensive phenomena posing a direct threat to human life and health – the highest social values – are criminal road accidents, alongside other risk factors. Current realities demonstrate that the number of fatalities and injuries resulting from road accidents is practically comparable to the number of victims of armed conflict. Legislative inadequacies in providing professional legal assistance to victims hinder road accident victims and their families from defending their rights and lawful interests, seeking just punishment for those responsible, and obtaining rightful compensation. At the same time, the lack of scientifically grounded methodologies on the actions of a representative of a road accident victim in criminal proceedings results in the limited effectiveness of such assistance. Thus, measures are needed to improve the procedural status of the road accident victim and their representative, enhance the quality of criminal procedural legislation, and increase the effectiveness of the criminal procedural activities of the victim’s legal representative.

THE INSTITUTION FOR THE USAGE OF SPECIAL KNOWLEDGE IN CRIMINAL PROCEEDING AS THE TOOL FOR THE ACTIVITY OF THE VICTIM OF THE TRAFFIC ACCIDENT’S REPRESENTATIVE AT THE STAGE OF PRE-TRIAL INVESTIGATION

    Розроблення засад впливу представника потерпілого від дорожньо-транспортної пригоди на використання спеціальних знань експертів і спеціалістів у кримінальному провадженні, а також внесення пропозицій щодо вдосконалення чинного законодавства в цій частині становлять мету цього дослідження. Для її досягнення поставлено такі завдання: визначити загальні юридичні проблеми впливу представника потерпілого від дорожньо-транспортної пригоди на використання спеціальних знань у кримінальному провадженні та запропонувати напрями вирішення цих проблем; окреслити коло завдань, які можуть бути вирішені за допомогою конкретних експертиз представником потерпілого від дорожньо-транспортної пригоди; визначити типові ситуації, в яких представнику потерпілого від дорожньо-транспортної пригоди потрібно проявляти активність у питаннях організації залучення спеціалістів і призначення експертиз; запропонувати перелік та послідовність можливих дій представника потерпілого від дорожньо-транспортної пригоди у згаданих ситуаціях; розробити основи тактики зазначених дій. The purpose of this study is to develop principles of the victim of the traffic accident’s representative influence on the usage of the special knowledge of experts and specialists in criminal proceedings, as well as to make proposals for improving the current legislation in its, corresponding to this case, part. To achieve the abovementioned goal the following tasks have been set: to determine the general legal problems of the victim of the traffic accident’s representative influence on the usage of special knowledge in criminal proceedings and to propose directions for solving these problems; to outline the range of tasks which can be solved with the help of specific examinations by the representative of the victim of the traffic accident; to determine typical situations in which the representative of the traffic accident’s victim needs to be active in the questions conserning organization of the specialists’ involvement and the examinations’ appointment; to offer a list and a sequence of possible actions of the victim of the traffic accident’s representative in the abovementioned situations; to develop the basics of the specified actions’ tactics
