    У статті досліджується правова природа договорів дарування і пожертви. Зазначено, що у нинішніх умовах стрімко зростає роль договору як універсальної та найдоцільнішої форми опосередкування ринкових відносин. Цивільно-правовому договору належить особливе місце у системі виникнення цивільних прав і обов’язків. Він є основною правовою формою, що опосередковує рух цивільного обороту, переміщення матеріальних цінностей і надання послуг. Одним із видів даного договору є договір дарування, якому присвячено 55 Главу Цивільного кодексу України (далі – ЦК). The article examines the legal nature of donation and donation agreements. It is noted that in today’s languages the role of the contract as a universal and the most appropriate form of mediation of market relations is growing rapidly. Civil law contract has a special place in the system of civil rights and obligations. It is the main legal form that mediates the movement of civil turnover, movement of property and services. One of the types of this agreement is the donation agreement, which is dedicated to Chapter 55 of the Civil Code of Ukraine (hereinafter – the CC).
