    Процесуальні основи статусу слідчого судді у кримінальному провадженні. Procedural basis of the status of the investigator of the judge in criminal proceedings.

    У дисертації здійснено комплексне дослідження теоретичних та практичних проблем діяльності слідчого судді як суб’єкта реалізації функції судового контролю у кримінальному провадженні. Проведено історико-правовий аналіз становлення та розвитку інституту судового контролю в кримінальному процесі України. Вивчено зарубіжний досвід реалізації слідчим суддею функції судового контролю в кримінальному судочинстві. Окреслено особливості законодавчої регламентації діяльності слідчого судді як суб’єкта реалізації функції судового контролю у кримінальному провадженні. Дослідження процесу реалізації повноважень слідчого судді здійснено в контексті розгляду клопотань слідчого, прокурора про застосування заходів забезпечення кримінального провадження, про проведення слідчих (розшукових) дій, негласних слідчих (розшукових) дій та інших процесуальних дій. Розроблено пропозиції про внесення змін та доповнень до КПК України щодо удосконалення регламентації діяльності слідчого судді у кримінальному провадженні.The thesis presents a comprehensive study of theoretical and practical problems of the investigating judge functions as bearers of judicial review in criminal proceedings. Done historical and legal analysis of the formation and development of the institution of judicial control in criminal proceedings Ukraine. Studied foreign experience implementing functions of investigating judge judicial control in criminal proceedings. The peculiarities of the legal regulation of the investigating judge functions as bearers of judicial review in criminal proceedings. Investigation of implementing powers of the investigating judge made in the context of applications prosecutor to ensure application of the criminal proceedings in the investigation (search) operations, covert investigative (detective) actions and other proceedings. Suggestions on amendments and supplements to the Code of Ukraine concerning improvement regulation of the investigating judge in criminal proceedings.
