    У методичних рекомендаціях запропонована криміналістична методика розслідування кримінальних правопорушень у сфері діяльності небанківських фінансових установ в Україні. Надано криміналістичну класифікацію та характеристику кримінальних правопорушень у сфері діяльності небанківського фінансового сектору. Детально охарактеризовано способи учинення кримінальних протиправних діянь, предмет злочинного посягання, обстановку та слідову картину вчинення, особу злочинця. Визначено обставини, які підлягають встановленню на початковому етапі розслідування, а також конкретизовані типові слідчі ситуації. Розкрито особливості проведення окремих слідчих (розшукових) дій та заходів забезпечення кримінального провадження під час розслідування кримінальних правопорушень у сфері діяльності небанківських фінансових установ. Видання призначене для працівників правоохоронних органів, а також курсантів і слухачів, науково-педагогічного складу закладів вищої освіти зі специфічними умовами навчання. The methodological recommendations propose a forensic methodology for investigating criminal offenses in the field of non-banking financial institutions in Ukraine. A forensic classification and characteristics of criminal offenses in the field of non-banking financial sector are provided. The methods of committing criminal offenses, the subject of the criminal offense, the circumstances and the trace of the offense, and the identity of the criminal are described in detail. The circumstances that must be established at the initial stage of the investigation are determined, and typical investigative situations are specified. The features of conducting individual investigative (detective) actions and measures to ensure criminal proceedings during the investigation of criminal offenses in the field of activities of non-banking financial institutions are disclosed. The publication is intended for law enforcement officers, as well as cadets and students, scientific and pedagogical staff of higher education institutions with specific learning conditions.

    У статті розглядається отримання зразків для експертизи як слідча (розшукова) дія та відповідний засіб доказування. За результатами дослідження пропонується деталізувати структуру отримання зразків для експертизи та виділяти підготовчий, робочий та заключний етапи її проведення. Розглядаються дії суб’єкта розслідування на кожному з виділених етапів відповідно до їх мети та завдань. Аналізуються види зразків для експертизи та порядок їх отримання відповідно до положень Кримінального процесуального кодексу України. Відстоюється думка щодо необхідності правильного розуміння біологічних зразків особи: всі зразки, пов’язані з життєдіяльністю особи як біологічної істоти. The article considers the receipt of samples for examination as an investigative (search) action and an appropriate means of proof. According to the results of the study, it is proposed to detail the structure of obtaining samples for examination and to distinguish the preparatory, working and final stages of its implementation. The actions of the subject of investigation at each of the selected stages in accordance with their purpose and objectives are considered. The types of samples for examination and the procedure for obtaining them in accordance with the provisions of the Criminal Procedure Code of Ukraine are analyzed. There is an opinion about the need to properly understand the biological samples of a person: all the samples associated with the life of a person as a biological being.
