    ІДЕЯ РЕСОЦІАЛІЗАЦІЇ ЗАСУДЖЕНИХ ОСІБ У НАУКОВІЙ СПАДЩИНІ М. М. ГЕРНЕТА

    У статті розглядається внесок відомого дореволюційного й радянського юриста М.М. Гернета (1874–1953 рр.) у розробку теоретичної бази та практичну реалізацію ідеї ресоціалізації засуджених осіб. Учений запропонував здійснення ресоціалізації шляхом зміни принципів функціонування місць позбавлення волі, а також використання організаційних форм, які впливають на поведінку засуджених. До важливих факторів, що сприяють проведенню ресоціалізації, М.М. Гернет зараховував боротьбу з алкоголізмом, доводячи за допомогою статистичних даних наявність значної кількості злочинів, скоєних у стані сп’яніння. The article deals with the contribution of the famous pre-revolutionary and soviet lawyer M. Gernet (1874–1953) in the development of a theoretical framework and practical implementation of the idea of resocialization of convicts. The scientist suggested the implementation of resocialization by changing the principles of the prison, and the use of organizational forms that affect on the convict’s behavior. Among the important factors that facilitate resocialization, M. Gernet included the fight against alcoholism, proving using statistical presence of a large number of crimes committed by drunken persons.
