Статтю присвячено особливостям правового регулювання надання згоди на донорство органів і тканин, визначенню дискусійних аспектів і шляхів їх вирішення. Проаналізовано колізійні положення законодавства щодо надання згоди живим потенційним донором, переваги та недоліки презумпції згоди й презумпції незгоди, запропоновано зміни до чинного законодавства. This article is dedicated to the peculiarities of the legal regulation of granting approval for donorship of the organs and tissues, determination of dispute aspects and ways for its solution. It was analyzed collisional regulations of the legislation regarding to the granting approval to alive potential donors and advantages and disadvantages of the agreement and disagreement presumptions as models of giving the approval by deceased people, offered changes to the effective legislation.
