    Статтю присвячено дослідженню правової природи спеціальної конфіскації, яка в кримінально-процесуальному аспекті розглядається як спосіб вирішення долі речових доказів. З урахуванням теоретичних положень і норм чинного кримінального та кримінального процесуального законодавства визначаються гарантії забезпечення засади недоторканності права власності під час вирішення питання про спеціальну конфіскацію. The article is dedicated to the research of the legal nature of special confiscation, which in the criminal procedural aspect is seen as a method of deciding of the fate of material evidences. Based on the results of the analysis of the theoretical positions and norms of the existing criminal and criminal procedural legislation the guarantees of software of principle of inviolability of property rights during use of special confiscation determined.
