    У статті розглядається загальний філософський і методологічний фон застосування наукової категорії «система» крізь призму кримінального права. Розрізняються категорії «система кримінального права» і «кримінально-правова система». Проілюстровано, що наукове розуміння поняття «кримінально-правова система» в сучасних умовах лише складається і є перспективним напрямом вивчення. Висловлено погляд, згідно з яким пояснювальна функція науки вимагає застосовувати категорію «система» у кримінальному праві не в онтологічному, а в епістемологічному розумінні. На підставі філософських категорій загального, особливого й окремого наведено приклади застосування наукової категорії «система» в аспекті кримінального права. The article examines the general philosophical and methodological background of the application of the scientific category «system» through the prism of criminal law. In particular, it is worth noting that in Ukrainian criminal jurisprudence today there are steps to build its philosophical and methodological base, which is related to specific issues of criminal law. Numerous works have been researched exploring the relationship of jurisprudence and philosophy. However, the author notes, the science of domestic criminal law still lacks those studies that reveal the meaning and application of the scientific category «system» from the perspective of criminal law.
